Welcome to LineTrack. These Terms and Conditions (“Terms”) govern your use of our website located at linetrack.com.au (“Website”) and the purchase of any line marking, road marking, or facility compliance services (“Services”) provided by LineTrack (“we,” “us,” or “our”).
By accessing our Website, requesting a quote, or engaging our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must cease using our Website and Services immediately.
1. About Us & Service Area
LineTrack provides professional line marking, car park layout, warehouse safety zoning, and civil/road marking solutions. Our primary service areas include South East Queensland (SEQ) and Northern New South Wales (NSW), including Brisbane, the Gold Coast, Sunshine Coast, Tweed Heads, Lismore, and surrounding regional areas.
2. Quotes, Estimations & Bookings
- Validity: All quotes provided by LineTrack are valid for thirty (30) days from the date of issue unless stated otherwise in writing.
- Accuracy of Information: Quotes are generated based on information, site plans, or measurements provided by the Client. If the onsite conditions differ significantly from the information provided, LineTrack reserves the right to amend the final pricing.
- Acceptance: A booking is considered confirmed only when the Client provides written acceptance of the quote and any required deposit has been cleared.
3. Site Access & Client Obligations
To ensure a high-quality, durable application, the Client must guarantee the following conditions are met prior to our team arriving onsite:
- Clear Access: The designated area must be entirely clear of vehicles, stock, debris, and personnel. Delay fees may apply if our technicians are blocked from working at the scheduled time.
- Surface Condition: Surfaces must be clean, dry, swept, and free of heavy oil, grease, or curing compounds unless surface preparation has been explicitly booked as part of our Services.
- Warranties on Substrates: LineTrack is not liable for paint failure, peeling, or premature wear caused by underlying substrate faults, moisture dampness rising through concrete/asphalt, or un-cured surfaces.
4. Payment Terms & Variations
- Invoicing: Payment terms will be specified on your invoice. Standard commercial terms require payment within seven (7) to fourteen (14) days from the date of completion, unless prior credit arrangements are approved.
- Deposits: For large-scale civil, industrial, or multi-day projects, a deposit may be required before materials are ordered and work commences.
- Late Payments: We reserve the right to charge interest on any overdue accounts at a rate of 2.5% per monthcalculated daily, alongside any debt collection fees incurred.
- Variations: Any additional markings, stencils, or layout changes requested by the Client onsite that deviate from the approved quote will be treated as a variation and billed accordingly.
5. Weather Conditions & Cancellations
- Weather Dependency: Line marking is highly dependent on weather conditions. LineTrack cannot apply materials on wet surfaces or during rainfall. If inclement weather prevents us from executing the job, we will reschedule to the next available date at no additional cost to the Client.
- Cancellations: The Client must provide at least twenty-four (24) hours’ notice for any cancellations or postponements. Failure to do so may result in a booking/mobilization fee.
6. Compliance, Standards & Warranties
- Regulatory Compliance: LineTrack aims to deliver layouts aligning with relevant Australian Standards (e.g., AS1742 for Traffic Control, AS1428 for Disability Access) and local council specifications where outlined in the scope of work.
- Warranty Limits: We offer a workmanship warranty on our applications against faulty installation. This warranty does not cover normal wear and tear, damage caused by heavy machinery/skidding tires, chemical spills, or mechanical abrasions.
7. Intellectual Property & Website Use
The content, logos, images, text, and design on linetrack.com.au are the intellectual property of LineTrack. You may not copy, reproduce, or distribute any part of this website for commercial purposes without our express written consent.
8. Limitation of Liability
To the maximum extent permitted by the Australian Consumer Law (ACL), LineTrack’s total liability for any claim arising out of the performance or non-performance of our Services is limited to either:
- Re-supplying the Services; or
- The total amount paid by the Client to LineTrack for the specific job in question.
LineTrack will not be held liable for any indirect, consequential, or economic loss, including loss of business profits or operational downtime, resulting from scheduling, weather delays, or curing times.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
